Osun State: Tribunal Sacks Adeleke, declares Oyetola as Winner of Governorship Election

The Osun State Election Petition Tribunal has sacked Ademola Adeleke as the state governor and declared the former governor Gboyega Oyetola as the winner of the governorship election.

The tribunal annulled the election of Adeleke, candidate of the People’s Democratic Party (PDP), and declared that Oyetola, candidate of the ruling All Progressives Congress (APC) then seeking a second term in office as the winner in an election held on the July 16, 2022.

Justice Tetsea Kume, delivering a majority decision declared that the Independent National Electoral Commission (INEC) did not comply substantially with the Constitution and the provisions of the Electoral Act.

He subsequently deducted the over-voting observed from the votes scored by the candidates and declared that Oyetola won the election, having polled 314, 921, while Adeleke’s score came down to 290, 266.

The judge directed INEC to withdraw Adeleke’s certificate of return and issued another one to Oyetola who won a majority of the lawful votes.

Details of the judgement of the Osun state governorship election petition tribunal indicate Adeleke was sacked due to over-voting. The tribunal explained that after deducting the excessive votes, the figure Oyetola polled at the election was 314, 921 while that of Adeleke came down to 290, 266.

Meanwhile, Governor Ademola Adeleke of Osun state has rejected the tribunal ruling which sacked him, describing it as “a miscarriage of justice”.

The Osun state governor vowed to challenge the ruling at the Court of Appeal. Ademola Adeleke vowed to appeal the tribunal ruling which sacked him as Osun state governor. Adeleke will remain in office pending the final determination of the matter by superior courts; the Court of Appeal and the Supreme Court.

INEC on Sunday, July 17 declared PDP candidate Adeleke as the winner of the Osun State governorship election.

The PDP candidate in the election result won 17 of the 30 Local Government Areas (LGAs) in the Osun State governorship election while APC candidate Oyetola was said to have won in the remaining 13 LGAs, according to results announced by INEC.

In total Oyetola of the APC polled 375,027 votes while Adeleke of the PDP claimed 403,371 votes.

Adeleke, a former senator and younger brother to the state’s first governor, Isiaka Adeleke, before the latest court judgement defeated Oyetola, by a margin of about 44,426 votes.

In the judgement the court has overturned the results of the July 16 election now declaring Oyetola as the winner of the election, having polled 314, 921, while Adeleke’s score came down to 290, 266.
